Suit claims Indiana BMV overcharged millions; court to determine repayment method

For the second time, the Indiana Bureau of Motor Vehicles is in court for overcharging Hoosiers millions of dollars.

INDIANAPOLIS (WTHR) - For the second time, the Indiana Bureau of Motor Vehicles is in court for overcharging Hoosiers millions of dollars.

After a trial Wednesday, a Marion County judge is considering exactly how much Hoosiers are owed due to overcharges for registrations and other fees.

The law firm that filed the class action lawsuit told Eyewitness News it believes approximately four million people are owed about $30 million in reimbursements.

An attorney for the BMV says it already credited individual accounts about $35 million for overcharges, which they believe represents the entire amount owed. The BMV says those refunds, which began in 2013, represent a better resolution than had been originally sought by the plaintiffs.

Attorneys suing the BMV say they believe any repayments should be made under court supervision.

They say the fees in question range from $0.50 to $5.50 and were paid between 2002 and 2013.

The judge is expected to decide the final amount owed to Hoosiers by early December.

This is the second lawsuit related to overcharges by the BMV. The first focused on overages related to driver’s license fees. After a $30 million settlement in 2013, millions of Indiana drivers received refunds.
